1. Use of Our Services

Eligibility

Account Responsibility

  • All activity under your account
  • The accuracy of data you provide

2. Subscriptions & Payments

Payments are processed via Stripe or another secure provider.

3. Scheduling & Booking Services (Schedula)

If using Schedula, you agree that:

  • You control the content and accuracy of your booking availability
  • M5G Digital is not liable for scheduling conflicts, cancellations, or customer disputes
  • You are responsible for compliance with text messaging laws (e.g., A2P 10DLC requirements)

M5G Digital provides the platform but does not manage your business operations.

4. Messaging & Communications (Twilio, SMS, Voice)

By using features involving SMS or voice:

  • You confirm you have consent to contact your recipients
  • You agree to comply with Twilio’s A2P 10DLC rules
  • You acknowledge M5G Digital is not responsible for carrier filtering, delivery delays, or message fees

Users are responsible for the content of communication sent through the platform.

5. API Use

If you use our APIs:

  • You must protect any API tokens
  • You may not misuse, overload, or attempt to bypass rate limits
  • We may revoke access at any time

6. Intellectual Property

All content, branding, code, and features within our Services are owned by M5G Digital. You may not reproduce or redistribute our intellectual property without permission.

7. Termination

We may suspend or terminate access if:

  • You violate these Terms
  • Your billing fails repeatedly
  • You engage in harmful or unlawful activity

You may cancel at any time through your account or by contacting support.

8. Disclaimer of Warranties

Our Services are provided “as is” without warranties of any kind.
We do not guarantee uninterrupted or error-free operation.

9. Limitation of Liability

To the maximum extent permitted:

  • M5G Digital is not liable for indirect, incidental, or consequential damages
  • Our total liability will not exceed the amount you paid in the prior 12 months
